Thank you for using Quote n Go! These Terms and Conditions ("Terms") govern your use of Quote n Go, operated by Quotengo Inc. ("Quote n Go," "we," "us," "our"), and apply to both Customers (Users seeking services) and Contractors (service providers). By accessing or using the Quote n Go platform, you agree to these Terms. If you do not agree, you must immediately stop using the platform.
If you are a consumer residing in Quebec, the arbitration and class action provisions of these Terms do not apply to any legal proceeding you bring against Quote n Go, and nothing in these Terms limits the rights you have under the Consumer Protection Act. 2. General terms
2.1. Platform Role and Limitations
Quote n Go is a technology-based marketplace platform designed to connect Customers and independent Contractors. It does not provide, supervise, perform, or manage any services directly. Quote n Go does not act as an employer, agent, contractor, or legal representative for any User, and its role is limited to facilitating service requests, enabling payment processing, verifying documentation, and supporting communication between Users.
Legal Classification & Disclaimer of Responsibility
Contractors using the platform are independent service providers. They are not employees, agents, or partners of Quote n Go, and are solely responsible for maintaining all required licenses, insurance, tax registrations, and regulatory compliance relevant to their business activities. Customers assume full responsibility for performing appropriate due diligence before selecting a Contractor, including verifying credentials, reviews, and service quality.
Quote n Go does not guarantee the legality, reliability, workmanship, safety, or overall outcome of services rendered by Contractors. All services are performed solely under the contract formed between the Customer and the Contractor, and Quote n Go is not liable for the execution, performance, or consequences of that agreement.
By using the platform, Users confirm that they understand and accept all provisions set forth in this agreement and that they have had the opportunity to seek independent legal advice before agreeing to these Terms. Users further acknowledge that they are entering into this agreement voluntarily, with full understanding, and that any failure to consult with legal counsel does not void their consent.
2.1.1 Service Agreements Are Between Users:
When a Contractor accepts a Service Request submitted by a Customer through the Quote n Go platform, a legally binding agreement is formed directly between those two parties. This agreement governs the specific services to be performed, the estimated price, and any materials or deliverables listed in the Service Request. The contract is not formed between either party and Quote n Go, and Quote n Go is not a party to the agreement.
Quote n Go does not negotiate or enforce the terms of the contract between Users, except for the pricing, payment, adjustment, cancellation, and dispute processes described in these Terms. Its role is limited to generating a structured Service Request form based on the Customer's selected service options, enabling digital acceptance by the Contractor, and managing payment flows according to the platform's policies.
In the event of a dispute or incomplete service, Quote n Go may intervene to evaluate whether the agreed scope of work was completed in accordance with the Service Request, but it does not act as a legal arbitrator, mediator, or representative of either party.
2.1.2 Payment Processing:
All transactions are processed securely through Stripe Connect. Quote n Go collects payments from Customers, holds them in its Stripe account until they are paid out to Contractors or refunded, and pays Contractors in accordance with these Terms. Quote n Go never stores full card numbers.
2.2. User Responsibilities
All Users of the Quote n Go platform, including both Customers and Contractors, are required to use the platform lawfully, responsibly, and in good faith. By creating an account or submitting a Service Request, each User confirms the following:
Each User must be at least eighteen years of age or the age of legal contract formation in their jurisdiction, whichever is greater. All information provided during registration, booking, or communication must be truthful, accurate, and complete. Users are responsible for maintaining the accuracy of their information and updating it as needed to ensure ongoing compliance.
Users are prohibited from using the platform for any illegal, harmful, fraudulent, or deceptive activities. This includes attempting to manipulate the pricing system, impersonating other Users, submitting false disputes or evidence, or interfering with the performance of the platform. Quote n Go reserves the right to investigate and take action against any misuse or violation of these Terms, including suspension or termination of the User's account.
All Users are expected to communicate respectfully and professionally, to comply with these Terms, and to follow all reasonable instructions provided by Quote n Go. Failure to comply with these obligations may result in loss of access to the platform, restriction of payment privileges, or other legal or administrative consequences.
2.3 Formation of a Legally Binding Agreement
Contracts formed through the Quote n Go platform are legally binding agreements between the Customer and the Contractor. The platform facilitates digital contract formation by enabling both parties to indicate acceptance through clearly defined actions within the app or platform interface. Quote n Go does not draft or become a party to the contract, and modifies it only as provided in Section 2.4.4, but provides the tools and structure necessary for its formation and execution.
2.3.1 Contract Formation Through Platform Action
A binding contract for services is formed when a Customer submits a Service Request and a Contractor accepts that request within the platform. This process involves the following stages:
- The Customer selects the services they wish to book and submits payment or a deposit. This action constitutes a formal offer to enter into a service agreement.
- The Contractor accepts the request, confirming their intent to perform the services listed and accept the terms associated with the Customer's selection.
- Upon mutual acceptance, the agreement is considered binding. The Contractor agrees to deliver the exact services detailed in the Service Request, and the Customer agrees to pay according to the platform's payment and dispute policies.
- If the scope, pricing, or timing of the Service Request is adjusted, the Customer will be notified as described in Section 2.4.4.
The acceptance of the Service Request through the platform constitutes the Contractor's agreement to be legally bound to the terms of the Customer's selected services. Contractors confirm that they accept the agreement as their own, that they are not entering into an agreement with Quote n Go, and that they have had the opportunity to seek independent legal advice before accepting the job.
2.3.2. Price Adjustments
Quote n Go may adjust the price of a Service Request, before or after Contractor acceptance, if the job differs from what was described, for example because of site conditions, additional time requirements, the quantity of materials required, or clarification of service scope. The Customer will be notified of any adjustment. Increases are charged with the Customer's next payment under their payment plan; decreases are refunded to the Customer's payment method. Adjustments are further described in Section 2.4.4.
2.3.3. Finalization of Terms and Post-Acceptance Adjustments
Once the Contractor has accepted the Service Request and the contract is finalized, both parties are bound to the terms as outlined. The Contractor must complete all services in accordance with the original Service Request and any approved modifications. The Customer acknowledges that certain pricing adjustments may occur after the work begins, in accordance with the platform's Dynamic Fee Policy outlined in Section 2.4.4.
Post-acceptance adjustments may include additional labor, extended time to complete the work, or site-specific conditions that increase job complexity. These changes may affect the final payment amount, will be notified to the Customer, and will be reflected in the final invoiced total as described in Section 2.4.4.
However, changes to materials, visible deliverables, scope of work, or the Contractor's profit margin are not permitted after the contract is formed unless the Customer explicitly agrees to the change in writing and the platform confirms the modification. If unauthorized changes are made, Quote n Go may withhold payment, reassign the job, or impose other platform-level remedies.
2.3.4. Legal Validity of the Agreement and Electronic Acceptance
Service agreements formed through the Quote n Go platform are fully enforceable under applicable laws governing electronic commerce and digital contract formation. By taking affirmative actions such as clicking "Book," "Accept," "Confirm," or equivalent actions within the platform, Users expressly consent to entering into a binding contract.
These digital contracts have the same legal validity and enforceability as written contracts signed in ink. This includes acceptance of the scope of work, materials, timing, pricing, and all other details agreed to through the platform's service selection and acceptance process. It also includes the User's consent to be bound by the full Quote n Go Terms of Service.
2.3.5. Record-Keeping and Enforcement
Quote n Go maintains digital records of all transactions, bookings, service modifications, and communications made through the platform. These records serve as the primary reference in the event of a dispute, review, or legal inquiry. In any claim involving a disagreement over service terms, payment, or delivery, the Quote n Go platform records will be used as the primary evidence of the contract, communications, and compliance.
2.4. Payment Terms
2.4.1. Deposit Policy and Payment Flow
At the time of submitting a Service Request, the Customer chooses to pay either the full price upfront or a deposit. The deposit constitutes Quote n Go's platform service fee, plus applicable taxes on it, and is applied toward the facilitation of the service, including platform access, Contractor matching, quote generation, and communication management. This amount is not part of the Contractor's compensation; it becomes non-refundable as described in Section 2.4.2.
Customers who pay a deposit are charged half of the remaining balance once every assigned Contractor has accepted the Service Request and the start date is twenty-one days away or less, which allows an early release of funds to the Contractor for required materials and preparation. The rest is charged when the job is completed and verified (Section 2.4.7). Customers who pay upfront are charged the full price at booking. In both cases, funds are held until they are eligible for release.
Later payments are charged automatically to the payment method saved by the Customer, who authorises these charges at booking. If a payment fails, the Customer will be notified and the payment retried; Quote n Go may delay or suspend the work or cancel the Service Request if a payment remains unpaid. Prices are charged in Canadian dollars or US dollars, as shown and selected at checkout.
2.4.2. Refund Conditions and Payment Adjustments
A Customer may cancel a Service Request by contacting Quote n Go. If the Customer cancels before Quote n Go makes its first payment to a Contractor (which occurs once every assigned Contractor has accepted and the start date is twenty-one days away or less), all amounts paid are refunded, including the platform service fee. After that first payment, the platform service fee becomes non-refundable, and the Customer is refunded the amounts paid for work not yet performed, less the value of work already performed and related costs already incurred, such as travel.
Refunds for service-related charges are calculated line-item by line-item. In addition to cancellations and to price decreases under Section 2.4.4, a refund may be issued when a Contractor fails to deliver services in accordance with the scope set out in the accepted Service Request. All refund decisions are made based on objective documentation submitted through the platform and are proportional to the dollar value of the line item(s) found to be incomplete.
2.4.3. Platform Fees and Cost Transparency
When a Customer books a service through Quote n Go, the total amount charged includes both the Contractor's compensation and the Quote n Go platform service fee. This platform fee is not a charge for labor or service performance and should not be interpreted as such. It supports:
- The generation and submission of Service Requests to Contractors,
- Contractor verification, communication tools, and secure payment infrastructure,
- Dispute resolution and service monitoring,
- Ongoing platform development and support.
All pricing is clearly disclosed before a Customer confirms any payment. Platform fees may be structured as a fixed amount or as a percentage of the final service total.
Applicable sales taxes (such as GST/HST, QST, PST, or US state and local sales taxes) are calculated based on the service and the property's location, shown before the Customer confirms payment, and added to the price. Where required or permitted by law, Quote n Go collects and remits these taxes as the marketplace operator, and Contractors must not charge them to the Customer again.
2.4.4. Dynamic Fee Policy and Adjusted Pricing
Quote n Go reserves the right to revise pricing or platform fees based on real-world job conditions. Adjustments to the total service fee may result from:
- A change in the type or quantity of materials required,
- The number of laborers or specialists needed,
- Expansion of scope due to structural or site-specific complexities,
- Revisions to Contractor wages, overhead, or required profit margin,
- Failures in the automated pricing algorithm to account for real-world conditions,
- Errors in the Customer's original service description, or
- Unforeseen increases in the time required to complete the job.
Quote n Go may adjust the price if the job differs from what was described. The Customer will be notified of any adjustment. Increases are charged with the Customer's next payment under their payment plan, and decreases are refunded to the Customer's payment method. A Customer who does not accept an increase may cancel the affected line items before the work begins and receive a refund of the amounts paid for them.
2.4.5. One-Time Services
One-time services are defined as non-repeating jobs with a defined start and end date. These may include installations, seasonal cleanups, roofing, and other project-based jobs. All one-time services follow the same core logic for deposit collection, fund holding, refund eligibility, and line-item verification as described in this section.
2.4.6. Recurring Services
Recurring services are services that repeat on a regular basis, such as weekly lawn care, monthly maintenance, or seasonal property servicing. These services are booked as a single season contract whose price is the per-visit price multiplied by the number of scheduled visits, and are paid using the payment options described in Section 2.4.1. A visit that is not performed may be disputed and credited under Section 3.3.
2.4.7. Fund Release Policy
Apart from the early release described in Section 2.4.1, Quote n Go will release the remaining funds only when all of the following conditions are met:
- The Contractor has confirmed that the service is complete and Quote n Go has marked the job as done;
- The seven-day dispute period has expired without a valid dispute, or any dispute has been resolved; and
- The final payment due from the Customer under their payment plan has been collected.
2.4.8. Dispute Handling and Payment Withholding
If a Customer disputes one or more line items or visits within seven calendar days of the job being marked as done, Quote n Go will hold the payment tied to the disputed items. The Contractor will be notified and asked to respond with supporting information or to offer a resolution.
2.4.9. Scope Completion Enforcement
All services on the platform are selected using standardized line-item descriptions, which define the contractual deliverables. Contractors who accept a Service Request agree to complete every listed item exactly as described.
2.4.10. Promotions, Promo Codes, and Referrals
Promotions and promo codes are subject to the conditions shown with them, such as validity dates, eligible regions, minimum amounts, first-order-only, or usage limits. Only one promo code may be used per order. Promotions reduce the platform service fee and have no cash value.
When a person referred by a User creates an account through the User's referral link and has not yet booked, they receive a credit of $100 toward their first booking. The referring User receives a $100 credit once that first booking reaches its first Contractor payment. Credits apply automatically at checkout, reduce the platform service fee, are limited to the deposit when a deposit is paid, have no cash value, and cannot be transferred. A referral credit is voided if the referred booking is cancelled before it qualifies. Quote n Go may modify or end the referral program at any time and may void credits obtained through fraud or abuse.
2.5. Dispute Resolution
In the event of a disagreement regarding service completion, payment, or task quality, Customers and Contractors must first participate in Quote n Go's internal dispute process, as described in Section 3.3.2. This process serves as the first and mandatory step prior to arbitration or external legal action.
Quote n Go functions exclusively as a neutral facilitator. It does not act as an arbitrator, mediator, or legal representative for either party. Its role is limited to evaluating whether the terms of the Service Request were fulfilled, based on submitted documentation and the evidence available through the platform.
2.6. Postponing a Scheduled Service
Customers may request to postpone a scheduled service by providing at least forty-eight hours' notice prior to the agreed start date. The postponement request must be submitted to Quote n Go by contacting customer support and include the new proposed service date. A postponement may change the timing of scheduled payments.
2.7. Limitation of Liability
To the fullest extent permitted by law, Quote n Go shall not be held liable for any loss, damage, or claim resulting from the conduct, services, or negligence of Contractors using the platform. This includes, without limitation, any personal injuries, property damage, service delays, defective workmanship, or failure to deliver agreed services.
Quote n Go's liability, if any, is strictly limited to the platform fee collected for the disputed service. Quote n Go shall not be held liable for consequential or indirect losses, including but not limited to property value loss, business interruption, reputational harm, or emotional distress. In no event shall any claim exceed the total platform fee charged for the specific transaction at issue. These limitations do not apply to liability that cannot be limited or excluded under applicable law, including the consumer protection laws described in Section 6.9.
3. Customer terms
For Users requesting services from Contractors
Customer Acknowledgement of Contractor Responsibility
By using Quote n Go, Customers explicitly agree that:
- They are hiring Contractors at their own discretion, and Quote n Go is not responsible for the service outcome.
- They must perform due diligence in selecting Contractors, verifying credentials, and approving materials.
- They cannot hold Quote n Go accountable for Contractor actions, financial losses, or damages.
In legal disputes, Customers and Contractors must resolve the matter independently—Quote n Go will not be a party to lawsuits or claims.
3.1. Booking a Service
Customers initiate a Service Request by selecting predefined services and submitting the required property details, including specifications relevant to pricing and feasibility. Quote n Go attempts to match the request with the selected Contractor. If the selected Contractor is unavailable or declines the request, Quote n Go may propose a similarly qualified Contractor to fulfill the service.
Initial prices displayed on the platform are generated by Quote n Go's estimation system and reflect an informed estimate only. The final price is subject to adjustment as outlined in Section 2.4.4.
3.1.1. Price Adjustment Policies
Quote n Go may revise the estimated price, before or after a Contractor accepts a booking, if the job differs from what was described. Revisions may account for labor requirements, material sourcing, site conditions, or the Contractor's operational requirements, and are handled as described in Section 2.4.4.
3.1.2. Customer Approval for Alternative Contractors
When the originally selected Contractor is unavailable or declines the Service Request, or when work must be reassigned for quality or scheduling reasons, Quote n Go may assign an alternative Contractor of comparable qualification. The Customer will be notified of the change and, if they object, may cancel the Service Request for a full refund, provided that no work has begun.
3.1.3. If No Contractor Accepts
If no Contractor accepts the Service Request, Quote n Go will find another qualified Contractor or refund the Customer in full.
3.1.4. Service Scheduling and Date Confirmation
Customers are required to select a preferred service date at the time of booking. The assigned Contractor must confirm availability for that date before the booking becomes finalized.
3.2. Payment and Refunds
All payment, refund, and dispute procedures applicable to Customers are governed by the terms and conditions outlined in Section 2.4. That section is incorporated by reference and shall control in the event of any inconsistency.
3.3. Service Completion & Quality Assurance
3.3.1. When is a Service Considered "Complete"?
A service is considered complete on a line-item basis when all of the following conditions are met: the Contractor has confirmed that the work was performed and Quote n Go has marked the job as done, and the Customer has not raised a valid dispute within the seven-day resolution period, or any dispute has been resolved.
3.3.2. What is the Customer Dispute Process?
Customers have the right to dispute one or more line items or visits in a Service Request if they believe the Contractor failed to complete the agreed scope of work. Disputes must be submitted by contacting Quote n Go within seven calendar days of the job being marked as done.
3.3.3. What Happens When a Dispute is Filed?
When a Customer files a dispute, the line item(s) or visit(s) in question are flagged for review and the associated payments are held until the issue is resolved. Quote n Go initiates the dispute review process and notifies the Contractor of the claim.
Possible outcomes of the dispute include:
- The Contractor corrects the identified issue at no additional cost, after which funds may be released.
- The value of the work verified as incomplete is credited to the Customer: it is deducted from the amount still owed and, if the Customer has already paid more than the value of the work performed, the difference is refunded. The platform service fee is not refunded for disputed work that was booked and scheduled.
- No refund is granted if the work is deemed to have been completed properly and in accordance with the Service Request.
3.4. Customer Responsibilities
Customers are expected to cooperate fully in the successful delivery of services booked through the Quote n Go platform. In doing so, they agree to the following responsibilities:
- The Customer must provide accurate and complete information during the booking process.
- The Customer must be present during the scheduled service window or provide advance notice if they are unavailable.
- The Customer is responsible for following all instructions issued by Quote n Go relating to service preparation.
- The Customer may not request changes to the job scope or line items after the Contractor has arrived unless those changes are submitted and approved through Quote n Go's platform.
- Upon completion, the Customer is responsible for reviewing the work and must raise any valid disputes within seven calendar days.
3.4.1. Material Selection & Product Liability
Customers are responsible for selecting, reviewing, and approving any materials associated with their Service Request. While Quote n Go may display material options, images, or examples on the platform, these are provided for general reference only.
Quote n Go is not responsible for:
- Material shortages, delivery delays, or inventory-related issues experienced by the Contractor;
- Variations in color, texture, or other minor aesthetic details that fall within reasonable industry standards;
- The Contractor's choice of suppliers, provided the materials used are of comparable quality to those approved by the Customer.
3.5. Liability & Legal Disclaimers
By using the Quote n Go platform, Customers acknowledge and accept that all services are performed by independent Contractors who are not employees, agents, or legal representatives of Quote n Go.
Quote n Go is not liable for:
- Poor performance or substandard service outcomes;
- Property damage or personal injury caused by a Contractor;
- Any misrepresentation made by a Contractor, including their licensing, qualifications, or experience;
- Consequential or indirect losses such as loss of income, property devaluation, or emotional distress.
Quote n Go's liability, where legally applicable, is strictly limited to the amount of platform fees collected for the specific service in dispute, except where applicable consumer protection law does not permit such a limitation (Section 6.9).
4. Contractor terms
Contractors acknowledge that Quote n Go operates as a neutral platform that facilitates the connection between Customers and independent service providers. Quote n Go is not a party to any contract formed between a Customer and a Contractor and does not supervise or control how services are performed.
4.1. Independent Contractor Status
By using the Quote n Go platform, Contractors acknowledge that they are operating as independent business entities. Contractors are not employees, partners, subcontractors, or agents of Quote n Go. They are solely responsible for their own business operations, service execution, and legal compliance.
Each Contractor is responsible for maintaining all necessary business licenses, permits, and certifications required to perform their services under local, provincial, state, or federal law.
4.2. Accepting and Completing Bookings
Contractors are under no obligation to accept a Service Request and may decline any job without penalty. However, once a Contractor accepts a booking through the Quote n Go platform, they enter into a direct and legally binding agreement with the Customer.
Upon accepting a booking, the Contractor acknowledges that they are fully bound by the terms of the Service Request, including the specific line items selected by the Customer, the estimated pricing, and the scope of work as described on the platform.
4.3. Payment Terms & Regulations
All payments made to Contractors for services completed through the Quote n Go platform are governed by the platform-wide payment and release policies outlined in Section 2.4. Contractors are only eligible to receive payment for work that has been:
- Accepted as part of a Service Request,
- Completed in accordance with the Customer's original selection or an approved modification,
- Confirmed as complete and marked as done by Quote n Go, and
- Not disputed within the seven-day resolution period, or resolved in the Contractor's favour.
Contractors are prohibited from seeking or accepting direct payments from Customers. All compensation must flow through the Quote n Go platform using Stripe Connect.
For each booking, half of the Contractor's share is paid once every assigned Contractor has accepted and the start date is twenty-one days away or less, to cover materials and preparation; the rest is paid when the job is completed and verified. Contractors must complete Stripe's onboarding before any payout can be made. If a booking is cancelled, disputed, or adjusted after a Contractor has been paid, the amount payable is recalculated based on the work actually performed and costs incurred, and Contractors authorise Quote n Go to recover any overpayment, including by deducting it from future payouts. Contractors are responsible for their own income taxes and business registrations.
4.4. Liability, Indemnification & Legal Risk Allocation
Contractors are fully and solely responsible for the services they perform through the Quote n Go platform. By accepting a Service Request, the Contractor agrees to deliver the services in accordance with all applicable laws, regulations, industry standards, and the specific requirements selected by the Customer.
Contractors agree to indemnify, defend, and hold harmless Quote n Go and its affiliates, officers, employees, and agents from any and all claims, demands, losses, damages, liabilities, costs, or expenses (including legal fees) arising out of or related to:
- Property damage, bodily injury, or other harm caused in the course of providing services,
- A failure to complete work in accordance with the Service Agreement,
- Use of unauthorized materials or deviation from the agreed scope,
- Any misrepresentation of qualifications, licensing, or insurance status, and
- Any claim brought by a third party resulting from the Contractor's performance or conduct.
4.5. Account Termination & Performance Standards
Quote n Go reserves the right to suspend or permanently terminate a Contractor's access to the platform at any time, with or without notice, if the Contractor is found to be in violation of these Terms, applicable laws, or the platform's operational standards.
4.6. Dispute Resolution, Arbitration & Legal Recourse
4.6.1. Internal Dispute Resolution Process
Before pursuing arbitration or legal action, all Contractors must engage in Quote n Go's internal dispute resolution process. This process is the first step in resolving any disagreement between the Contractor and the Customer related to job completion, payment, or service quality.
4.6.2. Arbitration Clause
If a dispute arises between a Customer and a Contractor that cannot be resolved through Quote n Go's internal dispute process, the parties may elect to resolve their disagreement through binding arbitration.
Arbitration shall be administered by the Canadian Arbitration Association for disputes occurring in Canada, or by the American Arbitration Association for disputes occurring in the United States, in accordance with their respective rules and procedures.
4.6.3. Waiver of Class Action & Legal Claims Against Quote n Go
To the extent permitted by applicable law, Users agree that all disputes must be pursued on an individual basis and waive any right to participate in or bring class actions or group proceedings against Quote n Go. This waiver does not apply to consumers residing in Quebec, or in any other jurisdiction where it is not permitted.
4.7. Communication and Customer Exclusivity
4.7.1. Non-Solicitation and Platform Circumvention
Contractors agree not to solicit, accept, or provide services to any Customer outside of the Quote n Go platform if the relationship originated through the platform. This includes any attempt to divert Customers away from the platform, offer lower direct pricing, or suggest that the Customer cancel an existing or future booking in order to work privately with the Contractor.
4.7.2. Customer Interaction Period and Exclusivity Window
Contractors must not solicit, accept, or perform services for any Customer they met through the Quote n Go platform for a period of twelve months following the last completed job, unless those services are rebooked through the platform.
5. Privacy
Quote n Go's collection, use, and protection of personal information, including the rights Users have concerning their personal information, are described in the Privacy Policy. Quote n Go's use of cookies and similar technologies, and the choices Users have, are described in the Cookie Policy. Both form part of these Terms.
6. Governing law & amendments
6.1. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the following jurisdictions: for Canadian Users who are consumers, the laws of the province or territory where they reside and the federal laws of Canada applicable therein, and they may bring proceedings in the courts of that province or territory; for other Canadian Users, including Contractors, the laws of the Province of Ontario and the federal laws of Canada applicable therein; for United States Users, the laws of the State of Delaware, without regard to conflict of law principles, except where the consumer protection laws of their state of residence apply and cannot be waived.
6.2. Dispute Escalation and Optional Arbitration
If a dispute between a Customer and a Contractor cannot be resolved through Quote n Go's internal resolution process, the involved parties may choose to pursue resolution through arbitration or other legal channels, as permitted by applicable law.
Any decision to initiate arbitration is entirely at the discretion of the Customer and Contractor. Quote n Go is not a party to any such proceedings and does not participate in, oversee, or enforce the outcome of arbitration.
6.3. Waiver of Class Actions and Jury Trials
To the fullest extent permitted by law, United States Users also waive their right to a trial by jury in any action relating to these Terms.
6.4. Amendments and Policy Updates
Quote n Go reserves the right to update or revise these Terms at any time. If material changes are made, Users will be notified via email or platform notifications at least thirty days before the changes take effect. Continued use of the platform after the effective date of any updates constitutes acceptance of the revised Terms. Changes do not apply to bookings made before they take effect. Consumers residing in Quebec will receive the notice required by Quebec law and may refuse the change and terminate the agreement without cost.
6.5. Severability Clause
If any portion of these Terms is found to be invalid or unenforceable by a competent court or authority, the remainder shall remain in full force and effect.
6.6. Force Majeure Clause
Quote n Go shall not be liable for any delay or failure in performance due to events beyond its reasonable control, including but not limited to natural disasters, government restrictions or actions, pandemics, system failures, cyberattacks, or other emergencies.
6.7. Survival of Terms
The following provisions shall survive the termination of this agreement: Section 3.2 (Payment and Refund Terms), Section 4.4 and Section 3.5 (Indemnification and Liability), Section 5 (Privacy), and Section 6.2 (Dispute Resolution and Arbitration).
6.8. Entire Agreement
These Terms constitute the full and final agreement between the User and Quote n Go, superseding all prior understandings, negotiations, or representations.
6.9. Consumer Protection Laws
If a User is a consumer, nothing in these Terms limits the rights and remedies they have under the consumer protection laws of their province, state, or territory, including, in Quebec, the Consumer Protection Act and, in Ontario, the Consumer Protection Act, 2002. Where a provision of these Terms conflicts with those laws, those laws prevail and the provision applies only to the extent permitted. These Terms constitute a distance contract, and Customers receive a copy of these Terms and a confirmation of each booking by email.
6.10. Language
These Terms are available in French and in other languages. Users residing in Quebec are provided with the French version first, and the French version prevails for them in the event of any inconsistency. Elsewhere, the English version prevails, except where local law requires otherwise.
